APPENDIX 2 TO THE MOTORWAY RULES APPLICABLE ON A2 TOLL MOTORWAY SECTION ŚWIECKO - KONIN

 

According to Art. 13 sec.1-2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119 p. 1), hereinafter GDPR, this is to inform as follows:

 
  1. Personal Data Controller

The Personal Data Controller, hereinafter the Controller, shall be:

  1. Autostrada Wielkopolska S.A. with registered office in Poznań (61-248), Stanisława Zwierzchowskiego 1 street with respect to personal data of the users of Nowy Tomyśl - Konin section, email: dane.osobowe@mail.autostrada-a2.pl,

  2. Autostrada Wielkopolska II S.A. with registered office in Poznań (61-248), Stanisława Zwierzchowskiego 1 street with respect to personal data of the users of Świecko - Nowy Tomyśl, email: dane.osobowe@mail.autostrada-a2.pl.

 
  1. The goals of and grounds for processing

The goals of your data processing have been determined. In our capacity of data controller we shall process your data:

  1. with a view to handle tolling transaction on A2 motorway, including video surveillance:

    1. under Art. 6 sec. 1 letter f) GDPR as a legitimate interest pursued by the Controller and

    2. in addition, as refers the company Autostrada Wielkopolska S.A., given the fact that the handling of tolling transactions on A2 motorway is also the company’s legal obligation - under Art. 6 sec. 1 letter c) GDPR;

  2. with a view to consider complaints, claims, requests, notifications, via the form available at Service Areas or Points of Sale, via our website, hotline, submitted in writing or electronically - under  Art. 6 sec. 1 letter f) GDPR, as a legitimate interest pursued by the Controller,

  3. with a view to handle Internet applications delivered by the Controller via the website  - under Art. 6 sec. 1 letter f) GDPR, as a legitimate interest pursued by the Controller and under Art. 6 sec. 1 letter a) GDPR,

  4. with a view to handle social campaigns pursued by the Controller - under Art. 6 sec. 1 letter a) GDPR,

  5. with a view to pursue business claims, as the legitimate interests pursued by the Controller, according to Art. 6 sec. 1 letter f) GDPR,

  6. with a view to keep accounting books and tax documentation - under Art. 6 sec. 1 letter c) GDPR in conjunction with Art. 74 sec. 2 of the Accounting Act of 29 September 1994,

  7. with a view to handle deferred payment procedure - under Art. 6 sec. 1 letter b) GDPR.

 
  1. Data recipients

Your personal data may be transferred to:

  1. employees/partners of the Controller who have been authorized to process it at a request of the Controller,

  2. other data recipients, including:

  3. the Company Autostrada Eksploatacja S.A. with registered office in Poznań (60-004), Głogowska 431 (processing entity) as the entity dealing with maintenance of the motorway on our behalf,

  4. suppliers of technical and organizational services permitting the Controller to perform its obligations as the entity responsible for the operation of the motorway (in particular suppliers of teleinformatics services and suppliers of services permitting tolling transactions on A2 motorway),

  5. suppliers of legal and advisory services whenever the Controller pursues claims in connection with business conducted or considers complaints, claims, requests and notifications,

in compliance with any and all guaranteed security procedures in data transfer.

 
  1. Personal data transfer to third countries

The Controller shall not transfer data to any third  country or international organization.

 
  1. Retention period

Your personal data shall be retained by the Controller for the following period:

  1. data processed for the purpose referred to in item II.1 - for the period until completion of performance and  thereafter for the period required by mandatory provisions of law to secure potential claims and with respect to video surveillance data processing - for the period required to secure potential claims at a request of relevant authorities,

  2. data processed for the purpose referred to in item II.2 - for the period until completion of handling them and thereafter for the period required by mandatory provisions of law or to secure potential claims,

  3. data processed for the purpose referred to in item II.3 - for the period until the consent to process is canceled,

  4. data processed for the purpose referred to in item II.4 - for the period until the consent to process is canceled,

  5. data processed for the purpose referred to in item II.5 - for the period and to the extent required by mandatory provisions of law or to secure potential claims,

  6. data processed for the purpose referred to in item II.6 - for the period and to the extent required by mandatory provisions of law or to secure potential claims,

  7. data processed for the purpose referred to in item II.8 - for the period and to the extent required by mandatory provisions of law or to secure potential claims,

 
  1. The rights of data subjects

According to GPDR your rights include:

  1. the right to access your data and receive copies thereof,

  2. the right to rectify (adjust) your data,

  3. the right to delete data, restrict data processing,

  4. the right to object against data processing,

  5. the right to portability of data,

  6. the right to cancel a consent to data processing without affecting lawfulness of processing that took place prior to such cancellation, which shall mean that cancellation of a consent shall not act retroactively,

  7. the right to lodge a complaint with a supervisory authority – President of the Personal Data Protection Authority.

 
  1. Information on the requirement/voluntary nature of data disclosure

Personal data are freely given, yet where data is processed for the purposes referred to in sec. II.1-4, it shall be required for the purpose of proper performance of processes specified therein (refusal to provide personal data shall render it impossible to reply to such complaint, claim, notification, to use an Internet application, to participate in a social campaign or to use a deferred payment procedure)

 

Disclosure of personal data with respect to tolling transaction on the motorway is obligatory for the purpose of proper handling.

 
  1. Automated decision-making

We apply solutions on our website which monitor user behavior and allow profiling, however they do not involve automated decisions that would entail legal effect. Such solutions are applied by the Controller for management purposes and with a view to improve website operation.
